MD Labs and Owners Triumph in Lawsuit Dismissal
[Nevada, January 29, 2025] – MD Spine Solutions, LLC dba MD Labs (www.MDLabs.com) and its owners, Matthew Rutledge and Denis Grizelj, today announced the successful dismissal of a qui tam lawsuit filed by serial qui tam relator, OMNI Health Care of Melbourne, FL, solely owned by Dr. Craig Deligdish. The United States District Court for the District of Massachusetts granted summary judgment in favor of MD Labs, Mr. Rutledge and Mr. Grizelj, dismissing all claims with prejudice. This decisive victory marks a significant milestone for the company.
Dr. Deligdish, who has a history of pursuing qui tam lawsuits against healthcare companies, alleged that MD Labs engaged in fraudulent billing practices related to the use of PCR testing. However, the court, after careful consideration of the evidence, found no factual support to Dr. Deligdish’s claims.
The court held that no reasonable jury could find against MD Labs with respect to its compensation of its sales force, patient billing policies, or the medical necessity of its UTI testing.
OMNI alleged, in part, that MD Labs performed medically unnecessary PCR UTI tests, including tests ordered by OMNI. However, the Court found, “Dr. Deligdish admitted at his deposition that OMNI chose to order PCR UTI testing from MD Labs in every instance in order to substantiate [False Claims Act] allegations against Defendants. In other words, Dr. Deligdish caused submission of false claims for PCR testing which he knew were not medically necessary.”
